PLACING YOUR ORDER
You may place an order by filling an order request in the order form on the website of MAISON COUCOU (https://maison-coucou.com/) and clicking on the appropriate submission button. Upon placement of your order, you will receive a web order number. A placed order shall have to be accepted by us before it becomes binding upon us.
We may, at our sole discretion, refuse an order without any justification being required. In case of acceptance of your order, you will receive an order confirmation by email.
Each sale is subject to the terms and conditions contained herein and is deemed to have been fully accepted by you. No change with regard to these terms and conditions will be binding on us, unless it has been agreed upon in writing. The present terms and conditions shall at all times take precedence over the terms and conditions of the customer.
CANCELLATION OF ORDERS
In case of a cancellation of an accepted order, the customer shall have to pay for all costs that we have incurred due to the cancellation (e.g. delivery costs, administration costs,..)
The products are delivered via a courier service at the choice of MAISON COUCOU. The terms and conditions of delivery shall be mutually agreed by the parties. The customer must ensure that personal delivery of the products is possible at the place communicated by the customer for delivery. The customer is responsible for all costs and damages if personal delivery is impossible. The customer can indicate another place of choice where the products can be delivered (e.g. to the neighbors, to a sheltered place, etc.). The delivery is considered validly made by MAISON COUCOU if the products are delivered in accordance with the customer's indicated choice.
You will inform us in writing of any complaints regarding shortages or damage of the products within five (5) days as from receiving the products and await further instructions from us on what to do with the products. After the aforementioned term, the products will be considered to be in accordance with the agreed order and irrevocably accepted by you. The sole remedy for the customer in case the product is not in conformity, will consist of replacing these products at no cost or returning the amount paid, according to our exclusive decision and after returning these products in accordance with our guidelines.
Our prices (incl. VAT and shipping costs) are displayed on the website in euro. Custom duties are not included in such prices and will be charged additionally.
We reserve the right to change the prices displayed on the website at any time (except for already placed and accepted orders).
Payment can be done through any of the payment methods mentioned on the website. In case of late payment by the customer, MAISON COUCOU may charge a default interest of 10% per annum as from the date the invoice became payable.
The delivered products remain the property of MAISON COUCOU as long as the full price has not been paid. MAISON COUCOU reserves the right to retrieve the products in the event of late or non-payment by the customer.
In case the customer is a natural person-consumer, he or she has the right to revoke the agreement within a period of fourteen (14) calendar days after receipt of the products. The burden of proof for the timely exercise of the right of withdrawal lies with the customer. We explicitly ask you to complete and send the enclosed return form. If the form is not included with the order, it can be downloaded here. The products shall be returned in perfect condition in their original packaging. If a product is sent back and it appears to be damaged, MAISON COUCOU can claim compensation from the consumer that is proportional to the depreciation that the product has undergone. Any return of which the sender cannot be identified will be refused. The costs of the return shipment and the risk shall be borne by the customer. MAISON COUCOU recommends that a courier service be used when returning products in order to be able to track the parcel via a Track and Trace number. MAISON COUCOU cannot be held responsible for the repayment of goods that are lost, stolen or damaged.
The refund will be made within fourteen (14) days after receipt of the returned products by MAISON COUCOU, provided that all conditions as described above are strictly met. The above right of withdrawal does not apply if the customer is a legal entity.
MAISON COUCOU cannot be held liable for any loss, damage or other disadvantages incurred by the customer, caused by any circumstances beyond its reasonable control, including but not limited to, an act of a third party, default or late compliance of suppliers or sub-contractors, strikes, transport disruptions, imposed government restrictions.
MAISON COUCOU can only be held liable for damage suffered by the customer if such damage is directly and exclusively resulting out of a proven shortcoming on the part of MAISON COUCOU, or in the event of gross or intentional negligence on the part of MAISON COUCOU. Liability for indirect and/or consequential damages is excluded. In any case, MAISON COUCOU’ liability shall be limited to the amount paid by the customer under the agreement. MAISON COUCOU shall not be held liable for any losses incurred as a result of the unavailability of an item.
If any provision of these terms and conditions is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
GOVERNING LAW AND COMPETENT JURISDICTION
All disputes arising out of or in relation to the agreement between the parties shall be governed by Belgian law. Only the courts in Bruges, Belgium, shall have jurisdiction.
